Prayers Sought in the Court of Appeal:

An order of this Honourable Court —
(a) To allow the appeal (b) To set aside the ruling of the lower court dated the 27th day of November 2023, granting the stay of execution of judgment.

Simultaneously, Prince Kabir Olaoye has sought relief from the High Court, Ogbomoso, through a restraining order to halt any actions that could further entrench the contested developments in the Soun Saga.

Restrain Order Prayers from the High Court of Justice, Ogbomoso:

  1. An order of interlocutory injunction restraining the 1st to 12th Respondents from taking any further steps to enforce or give effect to the orders contained in the Ruling delivered on 27th November 2023 by the learned trial judge in Suit No. HOG/27/2022 pending the hearing and determination of the appeal filed against the said ruling.
  2. An order restraining the 1st to 12th Respondents from presenting Staff of Office or performing any other ceremony or action in furtherance of the installation or recognition of Pastor Afolabi Ghandi Oladunni Olaoye as the Soun of Ogbomoso pending the hearing and determination of the appeal filed against the said ruling.
  3. An order restraining the 1st to 12th Respondents from giving any effect to the appointment, selection, or recognition of Pastor Afolabi Ghandi Oladunni Olaoye as the Soun of Ogbomoso pending the hearing and determination of the appeal filed against the said ruling.

The National Economic Council on Thursday announced plans to channel at least $1.52bn donor funds into 36 special agro-industrial processing zones across the nation, aiming to create over 18.1 million jobs, including 100,000 farmers nationwide.

The first phase, which now runs in Kano, Kaduna, Kwara, Ogun, Oyo, Imo, Cross River states as well as the Federal Capital Territory, will gulp over $520m and is set to conclude by 2028.

Twenty-six states have expressed interest in joining Phase II of the programme, where the $1bn funding from the AfDB and other partners will be channelled. The states will begin documentation for the second phase in early 2024.

 Minister of Agriculture and Food Security, Abubakar Kyari, revealed this to State House Correspondents after the conclusion of the 137th National Economic Council meeting presided over by Vice-President Kashim Shettima at the Aso Rock Villa, Abuja, on Thursday.

Kyari said the funds were earlier pledges by the African Development Bank, Islamic Development Bank, and the International Fund for Agricultural Development, who voted $1bn to deliver SAPZs in 24 states at the Norman Borlaug International Dialogue, World Food Prize 202, in Des Moines, Iowa, USA, in late October.

This is aside from an initial $520m voted by the development partners for the same purpose.

“The Vice President who attended the World Food Prize in Des Moines, Iowa, met with the president of the African Development Bank. Dr Adesina has already pledged $1bn to the second phase,” said the minister.

He noted that his ministry made a presentation to the council outlining the collaborative program with the African Development Bank, the International Fund for Agricultural Development, the Islamic Development Bank, various state governments, and private investors.

He explained, “The seven states are Kano, Kaduna, Kwara, Ogun, Oyo, Imo, and Cross River, and like I said, with the FCT being the eighth partner in this programme.

“The quick wins here are that even in the stage of construction, you will have the opportunity for over 3,000 jobs.

“And at the end of the construction, opportunities will be for almost 500,000 jobs on each zone that is for each state and then also to support about 100,000 farmers.”

The minister described the SAPZs as a cross-cutting initiative and platform to attract private sector investment, add value to Nigeria’s agro-processing, and unlock opportunities for improved food security and job creation.

He revealed that the programme, which commenced in 2022, saw the active participation of seven states and the Federal Capital Territory, even as the zones would not only serve as production sites “but also hubs for aggregation and processing of agricultural produce.”

The programme has earmarked approximately $530m for the first phase, aiming to establish clusters of agricultural production and significantly reduce post-harvest losses, the former lawmaker noted.

“For instance, Kano has keyed in to do a lot of tomatoes in this zone. And we know that tomato losses run to almost 50 to 60 per cent. It is unacceptable in today’s agricultural sector,” the minister pointed out.

On Phase II, Kyari said, “We have already received expressions of interest from about 26 states so far. The second phase is supposed to start next year. This first phase will last for five years. And the documentation for Phase Two will begin by next year.

“There are only three states (Abia, Adamawa, and Yobe) that have not expressed interest. But as we were leaving here, one (Abia State) had already signified and are working on sending the expression of interest.”

The council also acknowledged the leading role of Ogun State in the development of these zones.

Kyari said despite Ogun’s delay in signing the Subsidiary Loan Agreement, a commitment was recently secured from the state government to sign it promptly.

To further expedite the initiative, the council approved “the accelerated transmission of the official documents to funders by the Federal Ministry of Finance” and granted a waiver from the same ministry for the payment of performance allowance to project staff by the funders as requested by the executing agency to “avoid project implementation risks.”

The NEC called for “a lot of enthusiasm from state governors to participate and key into” the project, which it said would drive significant economic growth through job creation and modernised agricultural practices.

The House of Representatives has called on its Committee on Emergency and Disaster Preparedness to review the activities of the National Emergency Management Agency to ascertain the extent of conformity with its mandate.

It also mandated the same committee to evaluate NEMA’s disaster response capabilities in terms of personnel competencies and response/management infrastructures.

The resolutions of the House followed the adoption of a motion titled: “Need to Strengthen the National Emergency Management Agency to Enhance Speedy Response to Emergencies and Disaster Occurrences in Nigeria.”

It was brought by Philip Agbese (APC, Benue).

Agbese, while leading the debate,  expressed concern about various complaints against NEMA by victims of disasters and stakeholders for its delayed and ineffective interventions.

According to him, NEMA has abandoned its duty of responding to emergencies and is now concerned only with the distribution of relief materials.

Agbese said if nothing was done about the situation “Nigerians will lose confidence which would lead to its eventual transformation into a bureaucratic institution and a cash cow for unscrupulous individuals.”

While adopting the motion, the House further mandated the Committee on Emergency and Disaster Preparedness to proffer recommendations on how to improve the agency’s efficiency and effectiveness and report back within four weeks for further legislative action.

President Bola Tinubu, on Thursday, assented to the Defence Industries Corporation of Nigeria Bill, 2023.

“The Defence Industries Corporation of Nigeria Act, 2023, repeals the previous iteration of the Defence Industries Corporation of Nigeria Act,” a statement signed by the President’s Special Adviser on Media and Publicity, Ajuri Ngelale, read Thursday.

The statement was titled ‘President Tinubu assents to Defence Industries Corporation of Nigeria Bill.’

The Defence Industries Corporation of Nigeria was established on August 1, 1964, by an Act of Parliament and revised as the DICON Act in Chapter 94 of the Laws of the Federation, 2004.

Sponsored by the Chairman of the House of Representatives Committee on Defence, Babajimi Benson (APC — Ikorodu Federal Constituency), the new iteration empowers the Defence Industries Corporation of Nigeria to: operate, maintain, and control subsidiaries and ordnance factories to manufacture, store, and dispose of ordnance and ancillary stores and material.

It also makes for the establishment of the Defence Industry Technology, Research, and Development Institute to create an elaborate scientific and research-based technological foundation for Nigeria’s defence industry through the leveraging of combined, multi-disciplinary research from multiple military research institutes for an application that leads to commercialisation and the development of new military technology and capacity in Nigeria.

The Act provides a comprehensive regulatory framework for the regulation of the manufacturing, distribution, storage, and disposal of defence articles in Nigeria, and incentivises the development of a nuanced financing architecture that enables private capital to facilitate research, development, and production in the defence sector in a transparent and predictable fashion.

The embattled Chairman of the All Progressives Congress in Rivers State, Emeka Beke, has called on the party’s National Chairman, Abdullahi Ganduje, to reverse the decision of the National Working Committee dissolving the party’s executive in the state.

Beke, while speaking in Port Harcourt on Thursday, said the tenure of the party’s executive in the state had yet to elapse.

Recall that the Ganduje-led APC NWC, on Wednesday in Abuja, announced the dissolution of the Rivers excos and replaced it with a caretaker committee to run the party’s affairs in the state for six months.

The chairman of the caretaker committee, Chief Tony Okocha, is a known ally of former Governor Nyesom Wike of the Peoples Democratic Party, who is now in alliance with the APC at the national level.

President Bola Tinubu had given the Rivers ministerial slot to Wike of the PDP, ignoring APC members, including Tonye Cole, who was the party’s governorship candidate in the 2023 general elections.

Cole is an allay of ex-governor Rotimi Amaechi, an arch-political rival of Wike in Rivers State.

Announcing the dissolution of the Rivers APC excos on Wednesday in Abuja, the National Publicity Secretary of the party, Felix Mouka, said, “We have resolved at the NWC meeting that Rivers APC should be dissolved and a caretaker committee put in place. The committee will have Chief Tony Okocha as chairman and Eric Nwibani as Secretary.

“The inauguration of the committee members will take place here at the party secretariat on Friday.”

But reacting to the decision of the party’s national leadership on Thursday, the sacked chairman of the Rivers APC, Emeka, insisted that in line with the party’s constitution, only the NEC has the power to dissolve an elected state exco.

He stated, “What does the constitution of the party say? Only NEC has the moral right. I am surprised the NWC said it has that power. I don’t think there is any time the NEC gave them (NWC) the power to do that. It is so shocking and surprising.”

He warned Ganduje to tread with caution,  describing him as a man who lives in a glass house.

“Ganduje knows how he became the National Chairman of this party. He is a man who is in a glass house; it is not good for you to throw stones. He has to reverse himself.”

On the claims that the action of the APC was to allow Wike to take over the party structure in the state, Beke said the current Minister of the Federal Capital Territory is not a member of the APC.

According to him, “Well I don’t know because he is not a member of our party. Wike is not a member of the APC in Rivers State. He is not a member of the APC national level.

“But if the national has decided to do that, then what comes out of that they  should be able to bear it.”

Also in a statement, the state Publicity Secretary of the APC, Darlington Nwauju, said the NWC does not have the powers to dissolve an elected executive, describing the action as extra-constitutional.

In the statement sent to our correspondent, Nwauju said, “The purported dissolution of the state executives of the APC in Rivers State is extra-constitutional and falls flat in the face of sound crisis management and peacebuilding.

“The NWC cannot without approval by the NEC take such extreme measures as dissolve duly elected executives of the party or grant waivers for any individual to occupy positions who is not qualified under our constitution to do so.

“Leaving our party in the hands of political undertakers is too much of a risk for all progressive-minded individuals in Rivers State.”

Anambra State Governor, Charles Soludo, has stated that the administration of President Bola Tinubu took over a “dead economy” bequeathed by its predecessors.

Soludo made the remark during an interview on Channels TV’s Politics Today on Thursday while analysing the naira’s decline under the new government.

The former Central Bank of Nigeria chief blamed worsening indicators on past violations of the apex bank’s establishment law, which bars deficit financing above five per cent of prior year revenues.

He accused the CBN under past management of illegally granting trillions in unbacked financing despite legal restrictions, contributing to current woes.

Soludo argued that from a macroeconomic standpoint, the Tinubu regime inherited an economy already beyond revival before it assumed office.

He said, “We explicitly put into the law that you can’t grant the Federal Government more than five per cent of the previous year’s actual revenue. And that so granted must be retired by the end of the year in which it was granted. And when the Federal Government fails to retire, the Central Bank is forbidden by that law from further advancing ways and means. That was the law 2007 Act of the Central Bank.

“But we sat all of us Nigerians watching the CBN illegally and brazenly violating that Act year on year and kept on printing money. That is when advance money is backed by nothing; you just credit the Federal Government with trillions N 4 trillion, N10 trillion, N15 trillion and we keep going.

“I said it before. This particular government inherited a dead economy from a microeconomic point of view, this government inherited a dead horse that was seen standing but people didn’t know that it was dead. I think it’s important for Nigerians to understand this.”

Earlier this month, Tinubu while negotiating an infrastructure loan in Saudi Arabia had also stated his administration took over substantial fiscal and infrastructure deficits.

The Attorney General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), will lead the committee set up to review the 2007 Public Procurement Act.

Also on the committee are the Minister of Finance and Coordinating Minister of the Economy;  Minister of Budget and Economic Planning; Director-General, Bureau of Public Procurement; Representative of the World Bank; Messrs KPMG Nigeria – (Technical Consultants); Permanent Secretary and Cabinet Affairs Office  (Member/Secretary).

The committee has one month to complete the assignment, according to a statement on Thursday by the Director of Information,  Office of the Secretary to the Government of the Federation,  Segun Imohiosen.

Imohiosen said the SGF,  George Akume, inaugurated the committee on Thursday in Abuja.

The statement quoted Akume as stating: “Having implemented the Public Procurement Act for over 15 years, this administration has seen the need to review and strengthen the provisions of the Act to make it more responsive to the needs of the people.

“The objective of this review is to ensure realistic procurement outcomes in the face of current economic realities and to enhance budget implementation and ease of doing business.”

He said the committee would undertake a holistic review of the Public Procurement Act 2007 by identifying key impediments militating against compliance with the Act.

“Other duties expected to be carried out by the committee are:  Make recommendations that will strengthen the provisions of the Act to ensure transparency, accountability, value for money, efficiency and timely delivery in the procurement of works, goods and services by ministries, departments, and agencies; develop a draft amendment bill for consideration by the Federal Executive Council and any other assignment as may be directed by the President,” the statement said.

The SGF urged members of the committee not to relent in the discharge of this huge task of reviewing the Public Procurement Act which will make public procurement processes seamless to deliver public goods and services.

The three suspects, whose identities were not disclosed by the military, were apprehended in Kaduna in the operations conducted between November 14 and 17, 2023.

The BWE TV reports that the Defence Headquarters on November 14, 2022, declared Turji and 18 others wanted and placed a bounty of N95m on them.

Regarded as one of the most dangerous bandit kingpins, Turji was reportedly involved in the alleged killing of about 200 people, including women and children, in January 2022.

He was also said to be behind the attack on Garki village in Sokoto, where over 80 people were murdered in a night in 2021.

Turji had on several occasions escaped military air strikes aimed at killing him.

Addressing journalists in Abuja, the Director, Defence Media Operations, Maj. Gen. Edward Buba, said the suspects were on their way to supply arms and ammunition to the bandit leader in Zamfara when they were arrested by troops.

He said,  “Between November 14 and 17 2023, troops in separate operations arrested three suspected arms dealers (names withheld)  in Zango Kataf and Kagarko LGAs of Kaduna State. Preliminary investigation revealed that they were on their way to deliver ammunition to Bello Turji, who is a notorious terrorist leader in Zamfara State. Troops recovered 504 rounds of 7.62mm Special ammo, 100 rounds of 7.62mm NATO ammo, three RPG chargers, three mobile phones, one ATM card and one vehicle.”

Buba also said troops discovered an Improvised Explosive Device with a letter in the Biu area of Borno.

“On  November 20, 2023, troops while on patrol discovered an IED with a hand-written letter in Biu LGA of Borno State. Analysis is ongoing, “ he said.

He said in total,  99  terrorists were killed while 198 of them were arrested across various theatres of operations.

“Troops also arrested 49 perpetrators of oil theft and rescued 139 kidnapped hostages. In the South-South, troops denied the oil theft of the estimated sum of N1,018,483,900.00 only.

“Troops in the Niger Delta area destroyed 245 dugout pits, 31 boats, 69 storage tanks, 23 vehicles, 162 cooking ovens, one pumping machine, three outboard engines, one tricycle, and 50 illegal refining sites.  Troops recovered 578,900 litres of stolen crude oil, 454,330 litres of illegally refined AGO, and 10,000 litres of DPK.”

The Court of Appeal in Abuja, on Thursday, affirmed the electoral victories of the governors of Nasarawa and Imo states,  Abdullahi Sule and Inuwa Yahaya, respectively.

Both governors were elected on the platform of the ruling All Progressives Congress.

The Independent National Electoral Commission had declared both governors winners of the March 18 governorship elections in their respective states.

But the opposition Peoples Democratic Party challenged their election at the tribunal.

In the case of Sule, the tribunal, led by Justice Ezekiel Ajayi, in a two-one split judgment, nullified his election and instead declared David Ombugadu of the PDP as the winner of the poll.

But in Gombe, the tribunal upheld Yahaya’s election,  dismissing the petition filed by Jibrin Barde of the PDP.

Displeased with his sacking by the tribunal, Sule of Nasarawa had approached the Court of Appeal, which, in its judgment on Thursday, restored his victory.

Justice Uchechukwu Onuemenam, who read the appellate court’s lead judgment in the Nasarawa case, nullified the evidence of eight witnesses presented by Ombugadu, which the tribunal relied on to sack Sule.

Justice Onuemenam said the evidence could not be admitted because the statements of the witnesses were not frontloaded or filed out of time.

Quoting  Section 285(5) of the 1999 Constitution and Section 132(7) of the Electoral Act 2022, the judge said written statements on oath must be filed alongside the petition, within the simulated time.

“Where a trial court admitted and acted on illegally inadmissible evidence, it is the duty of the appellate court to ensure that such illegally inadmissible evidence is expunged,” she held.

According to her,  the remaining statements and evidence from PW1, 2, 3, 4, 9, 10, 11, 14, 15, 16, 17, 18, 19 and 22 cannot sustain the judgment of the tribunal.

Also,  the court ruled that the tribunal was wrong to have deducted a total of 1,868 votes from Sule’s score based on the allegation of over-voting in four polling units.

“A party alleging over-voting must present voter registers in the affected polling units, BVAS machine, and Form EC8. The petitioners merely dumped their evidence on the tribunal without showing how over-voting occurred,” she said.

The appellate court also faulted the decision of the tribunal in summarily dismissing evidence and testimonies of  RW 1 to 22 called by Sule.

She said,  “It is perverse, and as the tribunal did not give reasons for its findings. A court must give reasons of fact for arriving at its findings. I resolve the issue in favour of the appellant.”

Furthermore, Justice Onuemenam held that the tribunal acted wrongly when it recomputed votes and made the declaration that returned the PDP candidate as the winner of the election.

“The appeal has merit and succeeds. It is hereby allowed; the tribunal judgment is dismissed. I set aside the majority order of the tribunal, “ Justice Onuemenam held.

In the case of case of Gombe, a three-man panel headed by Justice S.B. Belgore, upheld the verdict of the tribunal, which earlier affirmed Yahaya’s election.

Justice T. N. Orji-Abadua, who read the lead judgment declared that the appeal filed by Barde of the PDP lacked merit.

“All the issues are resolved in favour of the respondent and against the appellant.  No order as to cost.  The judgment of the lower tribunal is hereby affirmed,”  Justice Orji-Abadua held.

Meanwhile, the PDP has vowed to challenge Sule’s victory at the Supreme Court.

The Chairman of PDP in Nasarawa State, Francis Orogu, in an interview with The BWE TV on Thursday in Lafia, said,  “We are left with no choice than to do the needful. As far as I am concerned, we are taking the matter forward to the Supreme Court because we have seen some signs of injustice.

“The only option we have now is to appeal the case at the Supreme Court, and we hope and believe that with the overwhelming evidence we have, anybody that wants democracy to prosper in Nigeria will take our case more seriously than what the Appeal Court judges did.

“It is really unfortunate that we had to witness what we never imagined. Everybody knows that Nasarawa State’s case is unique. We had all the documents we needed, so for anybody to come and hide under any form of technicalities makes it a sad situation.”
